1. Introduction and Acceptance of Terms

Welcome to Albanian Dating ("Agency", "we", "our", "us"). These Terms & Conditions ("Terms") govern your application for, and use of, our website and all related services, including but not limited to personalized matchmaking, dating consultation, profile analysis, and event access (collectively, the "Service"). By accessing our website, submitting an application, or using our Service in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these terms, then you may not access or use the Service. Your use of the Service is also contingent upon your acceptance of and compliance with our Privacy Policy, which is incorporated herein by reference.

2. Eligibility and Representations

To be eligible for our services, you must be at least 18 years of age. By applying for membership or using our Service, you represent and warrant that you are legally single (i.e., unmarried, divorced, widowed, or in a legally recognized separation) and that you possess the full right, authority, and legal capacity to enter into this agreement and to abide by all of its terms and conditions. You further represent that all information you provide to the Agency is accurate, truthful, and complete to the best of your knowledge. Providing false, misleading, or incomplete information may result in the immediate termination of your account and forfeiture of any and all fees paid to the Agency, without recourse. We reserve the right to request verification of any information you provide.

3. Description of Services and Membership

Albanian Dating provides elite, personalized matchmaking, dating consultation, and related services for discerning individuals. The specific details, scope, and fees of our membership plans are detailed on our "Services" page and in your individual membership agreement. These services are provided at our professional discretion. We reserve the right to modify, suspend, or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that the Agency shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the Service. Any new features that augment or enhance the current Service shall also be subject to these Terms.

4. Member Accounts and Responsibilities

To use our Service, you will be required to create a confidential member profile with us. You are solely responsible for maintaining the confidentiality of any information we share with you, particularly the identities and personal details of other members. You agree to act with the utmost integrity and discretion. You are responsible for providing accurate, current, and complete information during our registration and profiling process and for updating this information as necessary to keep it accurate. Failure to do so constitutes a breach of these Terms, which may result in immediate termination of your membership.

5. Code of Conduct

You agree to use our services for lawful, personal, and non-commercial purposes only. You commit to acting in a respectful, honest, and courteous manner in all interactions with our staff and with any members you are introduced to. You are solely responsible for your interactions with other members. You explicitly agree not to engage in any of the following prohibited activities:

Engaging in any form of harassment, stalking, bullying, or abusive behavior, whether verbal or written.
Providing information that is false, misleading, fraudulent, or inaccurate.
Using the service for any commercial purpose, such as advertising, solicitation, or any form of prostitution.
Distributing spam, chain letters, or other unsolicited communications to members or staff.
Impersonating any person or entity, or misrepresenting your affiliation with a person or entity.
Disclosing confidential information about other members to any third party without their explicit consent.

We reserve the right, but have no obligation, to monitor disputes between you and other members and to terminate the accounts of those who violate this Code of Conduct. A breach of this section will be considered a material breach of the Terms.

6. Confidentiality and Privacy

We are deeply committed to protecting your privacy and maintaining the confidentiality of our members. All personal information you provide to us will be handled in strict accordance with our Privacy Policy. We will keep your information confidential and use it solely for the purpose of providing our services to you. We will not disclose your sensitive information to any third parties without your prior explicit consent, except as described in our Privacy Policy or as required by applicable law. Likewise, you agree to maintain the confidentiality of any and all information about other members that is shared with you.

7. Intellectual Property Rights

All content and materials available on our website, including but not limited to the Albanian Dating name, logo, text, graphics, designs, software, and the proprietary questionnaires and analysis methodologies, are the property of the Agency or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not use, copy, reproduce, modify, or distribute any of our intellectual property without our express prior written permission.

8. Fees, Payment, and Refunds

Our services are offered under paid membership plans. By selecting a paid plan, you agree to pay the specified fees as outlined in your membership agreement. All fees are quoted in Euros and are due in advance as per the terms of your plan (e.g., prepayment for a set number of months). All fees paid to the Agency are non-refundable, except as may be required by applicable law or at our sole and absolute discretion. We reserve the right to change our prices at any time; however, price changes will not affect any membership plan for which you have already paid.

9. Termination of Membership

We may terminate or suspend your account and access to the Service at any time, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. In the event of termination for cause (such as a breach of the Code of Conduct), you will not be entitled to any refund of unused fees. Upon termination, your right to use the Service will immediately cease. You may also terminate your membership at any time by providing written notice to us, but you will not be entitled to a refund. All provisions of the Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

10. Disclaimers of Warranty

Our service is provided on an "as is" and "as available" basis. The Agency makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. We do not guarantee that you will find a partner, achieve a specific number of dates, or attain any particular relationship outcome. Our role is to facilitate introductions based on our professional expertise and the information you provide. The success of any introduction ultimately depends on the mutual chemistry and decisions of the individuals involved.

11. Limitation of Liability

In no event shall Albanian Dating, its directors, employees, partners, or agents be liable for any indirect, incidental, special, consequential, or punitive damages (including, without limitation, damages for emotional distress, loss of data, or loss of profit) arising out of the use or inability to use our Service, or from any interactions or meetings with other members, even if we or an authorized representative has been notified orally or in writing of the possibility of such damage. Our total aggregate liability to you for any and all claims arising from your use of the service is strictly limited to the amount of fees you have paid to us in the 12 months preceding the claim.

12. Changes and Amendments to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will make reasonable efforts to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. It is your responsibility to check these Terms periodically for changes.

13. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of Albania, without regard to its conflict of law provisions. Any legal action, suit, or proceeding arising out of or relating to these Terms or the Service will be brought exclusively in the competent courts located in Tiranë, Albania, and the parties hereby irrevocably consent to the personal jurisdiction and venue therein.
